1About these terms
These Terms and Conditions ("Terms") are a binding agreement between you and X CyberArt ("GAME BASE", "we", "us"). We run the GAME BASE app and website (the "Service"), where you can play Checkers, Poker and Pool against other players for stakes paid in USDT.
By creating an account, signing in, depositing or playing, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2Who can play
To use the Service you confirm that:
- you are at least 18 years old, or the age of majority where you live if that is higher;
- you have the legal capacity to enter this agreement;
- you are playing for yourself, with your own money, and that money comes from a lawful source;
- you have one account only;
- you are not on a sanctions list and you do not live in or play from a territory we don't serve (see section 3).
We can ask you to confirm any of this at any time. If you can't, we may restrict or close your account.
3Where you can play
Online gaming laws differ widely. Some countries and regions restrict or ban real-money games, including skill games and games played with crypto assets. It is your responsibility to know the laws that apply to you and to follow them. You must not use the Service where it is unlawful for you to do so.
We may block or limit access in a territory if the law requires it or if we judge it necessary to protect the Service or its players. To do this we may use your IP address, device signals or information you give us.
Using a VPN, proxy or false location data to get around a restriction is a breach of these Terms. If we find it, we may suspend your account and hold your funds while we investigate, as set out in section 10.
4Your account
You can sign in with an email address and one-time code, with Google, or with your device's fingerprint. Fingerprint sign-in uses your device's own biometric system. We do not receive or store your fingerprint.
You set a PIN that protects withdrawals. Keep your PIN, your devices and your sign-in details private. You are responsible for everything done through your account unless you tell us promptly that it was compromised. GAME BASE staff will never ask for your PIN or your sign-in codes.
Don't pick a username that is offensive, misleading or impersonates someone else. You may not sell, share, rent or transfer your account.
5Identity checks
You can create an account and start playing without uploading ID. That does not mean we never check. We may ask for proof of identity, age, location or source of funds when:
- the law, a regulator, a payment partner or a blockchain analytics provider requires it;
- we see signs of fraud, cheating, underage play, multiple accounts or money laundering;
- your deposits or withdrawals are unusually large or frequent compared with how you play, or you reach the 5,000 USDT daily limit repeatedly;
- you ask us to lift a limit or to reopen an account you closed or self-excluded.
Until you complete a check we ask for, we may pause withdrawals, limit play or restrict your account. If we are legally required to stop serving you, we will tell you and return the funds we are allowed to return to your withdrawal address.
6How matches work
Matches are between players. You play other users, not the house. GAME BASE provides matchmaking, the game servers and settlement of results.
- Checkers and Pool are one-on-one matches.
- Poker tables seat two to five players.
- Rules, turn timers and stake options are shown in the app before you play.
- Waiting times shown in the app, such as an average wait of about 12 seconds, are estimates and not promises.
When you confirm a stake and a match starts, that stake is set aside from your wallet balance. If you cancel before an opponent is found, it returns to your balance. Our game server's record of a match is the official result.
7Stakes, fees and winnings
You choose your stake before each match. The pot is the total of all stakes. We keep a platform fee, currently 10% of the pot. The app shows the amount you can win ("To win") before you confirm. For example, in a one-on-one match:
Poker tables show the buy-in and the fee before you take a seat. We may change the fee, the stake tiers or the limits. A change applies only to matches you start after it is shown to you.
Winnings are added to your wallet balance as soon as the result is confirmed. If a match ends in a draw, each player's stake is returned in full and no fee is taken.
8Wallet, deposits and withdrawals
- USDT on TRC-20 only. We accept and send USDT on the TRON network. If you send another asset, or use another network, your funds can be lost for good and we can't recover them.
- Deposits are credited once the network confirms them. The minimum deposit is 10 USDT and the maximum is 5,000 USDT per day.
- Withdrawals go to a TRON address you enter. Check it carefully. Blockchain transfers cannot be reversed, and we are not responsible for funds sent to a wrong address you gave us. Every withdrawal needs your PIN.
- Timing. Withdrawals are usually processed within 1–2 hours. Security reviews, checks under section 5 and network congestion can make them take longer.
- Limits and fees. The minimum withdrawal is 10 USDT and the maximum is 5,000 USDT per day. A network fee of 1% applies to withdrawals. It is shown before you confirm.
- Payment partner. A third-party payment processor handles some blockchain payments. Their systems can have outages we don't control.
- Not a bank. Your balance is not a bank deposit, earns no interest and isn't insured. GAME BASE is not a bank or an exchange.
- Stablecoin risk. USDT is issued by a third party. We don't control it, and its value can move away from one US dollar.
- Tax. You are responsible for any tax on your winnings.
9Timeouts, disconnections and leaving
Each game has turn timers, for example 20 seconds per turn in Poker. If your timer runs out, the game's rules apply, such as an automatic fold or a forfeit. If you leave a match in progress, it counts as a forfeit. If a problem on our side stops a match from finishing, we cancel it and return every stake. Losing your own connection is not a problem on our side.
10Fair play
You must not:
- use bots, scripts, solvers or any assistance that plays or advises you in real time;
- collude with other players, including chip dumping and soft play;
- open more than one account, or play against yourself or against accounts you control;
- exploit a bug or error instead of reporting it;
- move money through the Service without genuine play;
- use the Service to launder money or to fund unlawful activity;
- hide your location, or sell or share your account.
If we find or reasonably suspect a breach, we may cancel the affected matches, remove winnings gained from cheating, suspend or close your account, hold your balance while we investigate, and report to the authorities where the law requires or allows it. We will return funds that are not linked to the breach, unless the law says we can't. Where we can, we will tell you why we acted.
11Chat and community
The Service includes group chat, challenge tickets, poker table invites and win receipts. When you accept a challenge, the stake is set aside as in section 6. Keep chat respectful. Don't post:
- harassment, threats or hate;
- spam, scams, or offers to trade outside the app;
- other people's private information;
- anything sexual involving minors. We have zero tolerance for this and will report it.
You own what you post, and you give us a licence to host and show it in the Service. We may remove content or restrict chat at our discretion.
12Play responsibly
Real money is at stake. You can lose it. Never stake money you need for rent, food, bills or debts. Take regular breaks and set yourself a budget. To set a limit, take a cooldown or exclude yourself, contact support. We will act on your request within 24 hours. We may also restrict accounts that show signs of harmful play. If gambling is causing you problems, please talk to a local support organisation.
13Risks you accept
You understand and accept that:
- you can lose your whole stake, and we can't promise you will win;
- results depend on your play and your opponent's;
- crypto transfers are final, networks can be slow or fail, and scams are common;
- software can have bugs, and your device or sign-in details can be compromised.
14Preventing financial crime
We do not allow money laundering, terrorist financing, sanctions evasion or fraud. We screen wallet addresses and transactions using third-party tools. We may refuse, delay or return a transaction, freeze funds, and report to authorities where the law requires or allows it. Where the law forbids us from telling you, we won't.
15Our rights in the Service
We own the app, brand, game code, designs and content. We give you a limited, personal, non-transferable licence to use the Service as these Terms allow. You may not copy, scrape, reverse engineer or resell it. If you send us feedback, we may use it without owing you anything.
16Privacy
Our Privacy Policy explains what we collect, such as account details, device and usage data, wallet addresses, transaction records and chat, and how we use and protect it. It forms part of these Terms.
17Availability and changes to the Service
We may change, pause or stop parts of the Service, including games, stake tiers, limits and features. We schedule maintenance when we can, but we can't promise the Service will always be available.
18Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we give no warranty that it will be uninterrupted or error free, that any result or payout timing is guaranteed, or that it is lawful to use where you are.
19Limits on our liability
To the fullest extent the law allows, GAME BASE is not liable to you for any loss, damage or claim arising from or connected with the Service. This includes indirect or consequential loss, loss of profit, and loss caused by a wrong address you entered, a third party, a blockchain network failure, or your device or sign-in details being compromised.
If we determine, in our sole discretion, that a verified loss to your wallet balance was caused directly by an error on our side, we may choose to reimburse you for that loss, in full or in part, after discussing it with you in good faith. Any reimbursement is a goodwill gesture. It is limited to the amount you lost directly because of that error, it is not an admission of liability, and it does not give you a right to any later or similar payment.
Nothing in these Terms limits liability that the law does not allow us to limit, such as liability for fraud, or your rights as a consumer where the law gives you rights that cannot be waived.
20Your responsibility to us
You agree to cover our reasonable losses, including legal costs, that arise from your breach of these Terms, your breach of the law, or your cheating or fraud.
21Closing your account
You can close your account at any time. Withdraw your balance first, or contact support and we'll help. We may suspend or close an account for a breach of these Terms, for legal or security reasons, or after one year of inactivity. When we close an account, we return the balance to your withdrawal address, except where we hold funds under sections 5, 10 or 14.
22Disputes and governing law
If you have a problem, contact support first. We will try to resolve it within 30 days. These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be handled by the courts of Abuja, Nigeria.
23Changes to these Terms
We may update these Terms. We will post the new version here with a new date and tell you in the app. Changes that matter to you take effect after 14 days' notice. If you keep using the Service after that, you accept the new Terms. If you don't agree, stop playing and withdraw your balance.
24General
These Terms are the whole agreement between us about the Service. If a part is found unenforceable, the rest still applies. If we don't enforce a right straight away, we haven't given it up. We aren't responsible for delays caused by events outside our control. We may transfer these Terms to a successor to our business, and you may not transfer yours. Only you and we have rights under these Terms. If we have versions in other languages, the English version applies if they differ.
